Aims

The aim of this unit is to develop student’s understanding and knowledge of implementing construction contracts and managing the potential issues/ challenges to ensure proper completion and finalization of construction contracts.

Unit Learning Outcomes

Students who successfully complete this unit should be able to:

  1. Describe the construction industry and procurement methods related to construction management
  2. Explain the implementation of construction contracts related to construction management
  3. Analyse the financial and time issues during the implementation of construction contracts
  4. Manage the completion and finalization of construction contracts
  5. Evaluate claims and resolve dispute from the claims and the effects of CIPAA 2012.

Content

  • Overview of the construction industry and procurement methods, including tendering process in the public sector
  • Implementation of construction contracts with standard forms being used, contractual relationship, etc.
  • Financial issues during the implementation of construction contracts, including why and how to address payments, variations, delays and disruptions, acceleration, estoppel, and CIPAA 2012
  • Time issues during the implementation of construction contracts that relate to delay, EOT, non-completion, suspension and termination
  • Completion and finalization of construction contracts that relate to CPC, defects, unfulfilled obligations, final accounts, and final certificate
  • Claims and dispute resolution that relate to claims under and arising from the contracts, how to settle them as well as and the effects of CIPAA 2012.
